The original debt was for XXXX XXXX XXXX with Consumer Portfolio Services, in XXXX due to failure by CPS to honor statements by their representatives this vehicle was voluntarily surrendered in XXXX however payments were made through XXXX and the vehicle was not picked up until XXXX. The last communication from this company was a Volubtay Surrender form sent via email in XXXX XXXX XXXX. Through my own tracking this vehicle was auctioned by CPS. Although we have moved twice since that time no contact was made despite mail forwarding and official change of address with the post office. This debt shows closed with a XXXX balance on our credit, however at the end of XXXX this year I was served with judgement papers from XXXX XXXX XXXX for the amount of {$8900.00}. I have never been contacted, and when I attempted to file a response I couldn't because they hadn't actually filed the papers, now as of XX/XX/XXXX, they filed the default of judgement. I was given no opportunity to file my response with the court, XXXX XXXX in XXXX XXXX North Dakota awarded it to them again with no time for me to file a response or knowledge that it had been filed. A response can't be filed officially until the case is filed and with no notice of it being filed and a judge that just pushes it through how can I fight a garnishment that is in fact not valid.
