Borrower Defense Application XXXX - XX/XX/XXXX I received a letter from the Department of Education alerting me that me student loans will be discharged in accordance with Exhibit C of theXX/XX/XXXX XXXX lawsuit that I was a full class member of due to the date of submission of my XXXX XXXX XXXX and the school I attended was on the list of for profit institutions that were being accused of misleading students in their loan applications and job placement assistance. I was also a part of the XXXX program and my loans were transferred from first Aidvantage to XXXX in XXXX, then from XXXX to Mohela in XX/XX/XXXX. I applied or XXXX XXXX on XX/XX/XXXX through a third party called XXXX XXXX XXXX which charged me XXXX to file a borrower defense and then input the wrong dates during submission. I attendedXX/XX/XXXX from XX/XX/XXXX through XX/XX/XXXX while taking a semester off around XX/XX/XXXX. My notes reflect the correct dates in the XXXX XXXX XXXX XXXX XXXX XXXX application was approved and as of XX/XX/XXXX my student loans are paid off and off my credit report, however I only recieved a {$200.00} check from XXXX for a payment I made them, and not the {$4700.00} I paid through XXXX when I was under the XXXX program. XXXX never transferred my loan payment history to MOHELA, and I never paid anything to MOHELA due to being in Forebearance from XXXX until the loans were paid off in XXXX, and there never had a payment history with MOHELA. When I go through the payment history from XXXX they show that amount of {$4700.00} was refunded to me, however instead of issuing a check to me, MOHELA instead applied the refund to the loan balance and lowered the loan balance instead which is in direct violation of the instructions from XX/XX/XXXX XXXX who is presiding over the XX/XX/XXXX XXXX XX/XX/XXXX. All refunds are to be issued in check form from the Department of the Treasury unless a borrower wants it applied in another format. I have attached my Borrower Defense Application, XX/XX/XXXX History, and my XXXX XXXX XXXX letter.
