Consumer Narrative
In XXXX, Chase Bank fabricated paperwork and misapplied payments to manipulate foreclosure action when I had never missed a payment. Everything about this was fraudulent but still upheld. 14 years later, I have obtained internal documents. Upon information and belief, the " loan '' was paid in multiple ways including in the way detailed below. However, I am currently being harassed by a new servicer to pay this " debt '' described here within. I will describe the details surrounding this " loan '' and then request that Chase answer the questions that follow. On XX/XX/XXXX Foreclosure Loss Mitigation paperwork was filed by Chase naming XXXXXXXX XXXX XXXX as investor. The reference number is XXXX. XXXX XXXX was the case employee. A XX/XX/XXXX dated document ( filed retroactively XX/XX/XXXX ) withdrew the foreclosure action. Document number XXXX. On XX/XX/XXXX in XXXX XXXX, Chase filed a NOTICE OF ELECTION AND DEMAND doc # XXXX and claimed to be owed {$210000.00} as holder of a negotiable instrument securing the indebtedness. On XX/XX/XXXX, two weeks after Chase filed doc # XXXX, title insurance was obtained but retroactively made effective for XX/XX/XXXX ( a week before Chase initiated foreclosure action ) effective through XX/XX/XXXX. On XX/XX/XXXX, two months after filing that claim and within the title insurance 's effective date, a payment was received by Chase for {$210000.00} plus {$7400.00} totaling {$220000.00} the exact amount reported to XXXX XXXX XXXXXXXX in doc # XXXX plus invented fees. This amount is reflected in payments XXXX and XXXX made on XX/XX/XXXX. 4 days after payments XXXX and XXXX were recorded, on XX/XX/XXXX the first publication of the sale of the house securing this alleged " loan '' was published in " XXXX XXXX XXXX. '' I filed bankruptcy and the home could not be sold. The NOTICE OF ELECTION AND DEMAND was withdrawn in XXXX. I asked Chase for a full accounting multiple times but was refused. When I began pressing Chase harder for a full accounting, filed a CFPB complaint in XXXX and took assertive action, Chase did a " loan modification '' filled with junk fees. I did not know about the formerly mentioned actions at that time. In XXXX, I began pressing Chase again about payments XXXX and XXXX when I learned about what appears to be a payoff. I was given the run around and then Chase transferred the " loan '' to XXXX XXXX XXXX instead of answering the following questions which I would like answered here : 1 ) How many times has loan number ending in XXXX assigned to XXXX XXXX been paid off? 2 ) Was loan number ending in XXXX assigned to XXXX XXXX paid off on XX/XX/XXXX? 3 ) Where did the XX/XX/XXXX, payments of {$210000.00} plus {$7400.00} totaling {$220000.00} come from? 4 ) Why was the payment referenced in question 3 recorded and then immediately withdrawn? 5 ) Were you paid any amount for the loan in question by anyone other than alleged debtor XXXX XXXX after making a claim in XX/XX/XXXX? If yes, detail those payments. 6 ) Was XXXX s/s XXXX paid any amount for the " loan '' in question by anyone other than alleged debtor XXXX XXXX after making a claim in XX/XX/XXXX? If yes, please detail those payments. 7 ) On XX/XX/XXXX ( 5 months after the over $ XXXX payment formerly referenced ) you filed a Proof of Claim in Colorado XXXX Bankruptcy Case XXXX XXXX for {$220000.00} of which I am still being harassed to pay to present day. Was this claim true? If true, was the amount correct? 8 ) When you transferred servicing to XXXX XXXX XXXX investment company, were you compensated for that? If so, please include details regarding what you received. 9 ) Why did you obtain title insurance on XX/XX/XXXX? 10 ) Is it customary to back date title insurance and make it effective two weeks before you bought it? 11 ) Please share the details of all activities on this the title insurance policy. 12 ) Chase employee XXXX XXXX was investigating payments XXXX and XXXX but never got back to me before or after you reassigned the " loan '' to XXXX. What were the results of her investigation? I have a recording of speaking to XXXX XXXX but it could not upload. 13 ) How much total dollars were collected on the account ending in XXXX including payments from XXXX XXXX and all other parties? 14 ) If more funds were collected than what were due, will you refund the payments to XXXX XXXX with compounded interest? 15 ) Was A XX/XX/XXXX dated document ( filed retroactively XX/XX/XXXX ) that withdrew the foreclosure action created retroactively? Document number XXXX. 16 ) Why did you have the home listed for sale on XX/XX/XXXX if you withdrew the home for sale on XX/XX/XXXX? 17 ) Was a XX/XX/XXXX dated document ( filed retroactively XX/XX/XXXX ) that withdrew the foreclosure action false information filed to clean up fabricated information discovered while XXXX was in bankruptcy?
