Re-submitting as I listed the wrong company... it's not originally owned by XXXX XXXX Portfolio Recovery acquired two debts XXXX XXXX and XXXX. Both bough in XXXX and XXXX XXXX in XXXX. I logged into my bank acct and noticed a debit labeled GARNISHMENT and our acct had been emptied to a XXXX balance with both our electric bill and XXXX XXXX bills pending. I wasn't aware of anything except a payment plan he has with the IRS. Fearing that something had happened I logged into our IRS acct but everything was current. I told him I would log into our local clerk of the court site and see if anything was there because we had not received anything from anything. I saw a case from XX/XX/XXXX that we hadn't been notified about and clicked the link and it said Portfolio Recovery and a garnishment had been granted for {$1100.00} for my XXXX XXXX acct. I kept clicking the paper symbols to view documents and eventually found one I was supposed to have received to submit information to contest the garnishment within an allotted amount of time ( I'm the head of household ), along with paperwork that XXXX XXXX would have received as well. However, now the allotted time has passed to contest the garnishment. Also, the statute of limitations on the debt to peruse legal action has passed. The debt was sold off to Portfolio Recovery in XXXX, however, this debt hasn't been paid on in at least XXXX yrs and the statute of limitations in Florida to pursue debt with legal action is XXXX yrs. This garnishment shouldn't have been granted to Portfolio Recovery in the first place. I also plan on contacting the State Attorney General. I did file a complaint with the state attorney general on XX/XX/XXXX as well.
