Consumer Narrative
Bank of America representatives failed to address the complaint I filed and continued to falsely purport that I willingly authorized the opening of the Money Market Savings account in question, despite acknowledging the use of a duplicated facsimile signature taken from an incomplete checking account form 's signature to facilitate opening it. Infuriated, I sent the following email and never got a response back. Instead, they locked me out of my online banking portal, and I later got an email that they would be closing both my credit card and checking account ( which I need to use in order to pay the credit card ), putting my credit at risk in what appears to be a retaliatory maneuver going against their duty of care to their customer of over ten years. I am appalled that such an esteemed banking institution could be this reckless in their disregard for my financial well-being in order to suppress any further investigation of mine into their private wealth management team 's ongoing misconduct. This is nothing short of criminal, fraudulent behavior to the extreme detriment of both my financial standing and emotional well-being. Their actions have resulted in my brokerage accounts with XXXX to be placed into a restricted status, rendering my ability to make spending account transfers from my XXXX account now impossible. The email I wrote in response to their mailed letter, wherein they continue to falsely proclaim I authorized the opening of the MMS, despite glaring evidence and testimony from my, has yet to see any response, and for transparency ( something these people seem to lack ) was written as follows : " Show me ONE email demonstrating my authorization for the opening of the money market savings account. I know exactly when I first started to get notification emails for that account and when I first got them for my checking account. And they aren't just one day apart. I have all correspondence dating back to when I signed a form intended to open just one account. The other savings account was a separate signature. As seen on the contracts I was sent copies of recently. The money market savings account was silently opened, without my consent, using a duplication of my signature from the account for which it was intended. There was NO correspondence even hinting at the idea that it would be used multiple times to produce " facsimile signatures '' to open other accounts. And there's not a single transaction of mine in that account. Only the two used to deposit and withdrawal XXXX from XXXX XXXXXXXX XXXX XXXX The investigation falsely continues to allege I explicitly authorized all these account openings, without evidence. Show me ONE email wherein the Money Market Savings account opening was discussed with me to demonstrate my ever being made aware of any intention to open that account, let alone being told of any plan for using the same form I signed for the purpose of opening my checking account to open others. The investigation 's letters to me sound very confident in their conclusion that they also have record of my affirmations. I recorded every call I made to BOA about this issue for exactly this reason. And so I look forward to hearing from any of you. '' The actions of the private wealth management client they seem keen on protecting from my pursuit of justice have exasperated the complications of handling the undue tax liability and subsequent insolvency their client has subjected me to upon her conversion of trust funds for her own personal use through this unauthorized joint MMS, and should this situation get any more offensive, I will have no choice but to bring every one of them to XXXX court. I am asking you, the CFPB, to take another look into the gross negligence of BOA and their private wealth management teams ' willful misconduct which has been taking place to the detriment of my valuable time, financial standing, and mental well-being. Ask yourselves, what would you do in my situation? I don't know where else I am to turn at this point. You are my only hope for being heard at this point. Please advise. After filing my first complaint with CFPB, their response just continued to falsely claim I authorized the opening of an account for which I am named the " Report Income '' individual which was used by a fiduciary to self-deal XXXX for which I am now expected to pay IRS the taxes without having received any benefit from these funds. Bank of America is protected a high-net-worth individual 's interest over the interests of far less financially comfortable, and far more honest tax-paying citizens of this country. This is shameful. Downright shameful. I can not even begin to describe how disappointed I am in the results of their " internal investigation '', albeit not surprised at this point.
