On Friday, XX/XX/year>, I was contacted by a collection representative from Chase Bank about two old credit card accounts. Both accounts are out of the statue of limitations in Ohio and both accounts were improperly opened and used by my ex wife without my knowledge. She was in charge of the finances and recently I found out that she opened numerous credit accounts in my name ruining my credit. We are now divorced and due to the time period being out of statue of limitations the police would not even take a report. Chase was previously provided all this information but still pursue which is frustrating to me. The representative was trying to collect the debt and i advised them again of this information and the fact that it is out of the SOL and they said we wont sue you and then proceeded to offer a settlement. When I told him I could not afford the settlement he was offering. He told me that then my case will be sent to the pre-litigation department for further action. This is a threat and an insinuation that I will be sued when they know they cant do so in order to try to get me to pay. This is a violation of the law and I could sue Chase for this and win, but I just once this to go away as I didnt open or benefit from these accounts. I do wonder how many other consumers they have threatened with litigation when they know its out of the statue of limitations?
