XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX Reference : Property Address : XXXX XXXX XXXX XXXX, AL XXXX THIS IS A COMPLAINT AGAINST BANK OF AMERICA AND XXXX FOR THEIR REFUSAL TO REFUND TO US THE SURPLUS FORECLOSURE FUNDS ON OUR PROPERTY Sir : We have not received any response from BofA on our original complaint - Complaint ID XXXX. In the meantime, we conducted further research on this matter. Our research indicated that there was no proper endorsement of the note ( loan ) by Countrywide Home Loans ( Countrywide ), the original lender, to XXXX Home Loans ( owned by Bank of America ). In addition, our research also indicated that XXXX XXXX XXXX XXXX ( XXXX ) which assigned or transferred the propertys mortgage ( or security interest ) to XXXX Home Loans was merely a nominee of XXXXXXXX XXXX XXXXXXXX ( Hometown ), the original mortgagee, and had no financial or ownership interest in the mortgage. Therefore XXXX was in no position and no legal standing to assign or transfer ownership interest of the mortgage to Countrywide ( see case ruling attachments ). This is related to our complaint previously filed with CFPB ( for which we have not received a response ) that Bank of America manipulated the calculation of interest and fees so they will eat up all the surplus funds resulting from the sale to XXXX on our above indicated residential property. We would like Bank of America to send us, if it is in their possession, a certified true copy of the note endorsement by XXXXXXXX XXXX XXXX. They can mail us a certified true copy at our address provided below. XXXX. It appears that if there was no proper endorsement of the note, then the note still belongs to XXXX XXXX and BofA had no ownership interest in our residential property that they sold to XXXX. XXXX. If that were the case, the SALE TO XXXX WAS VOID.. XXXX. As to the matter of fraudulent assignment of mortgage from XXXX XXXX XXXX this further proves that BofA has no ownership interest on the mortgage, let alone the note, and therefore the sale to XXXX was VOID. XXXX. We believe THERE ARE OTHER MEMBERS OF THIS CLASS. We are not the only ones. There should be an audit of all foreclosure sales of Countrywide to BofA, then to XXXX during that period.
