This company continues to blatantly disregard the issues contained in the letter and breach a fiduciary duty. The agreement lacked consideration therefore making it legally unenforceable under Arkansas XXXX XXXX Contract Formation, Arkansas Code XXXX ) Engaging in any other unconscionable, false, or deceptive act or practice in business, commerce, ( this company was informed the credit extended or granted was provided by the consumer social security card or number, which was misrepresented on the agreement. This company is also engaging in unjust enrichment assessing interest fees on money, credit, that was never loaned due to fractional reserve lending preserved by all banks constituting all banks only create money and obligations. Therefore the consumer only pledged the legally unenforceable agreement and this company should be held liable for their actions.
