In Complaint # XXXX I explained that I was a victim of an Internet Fraud activity in which my bank, XXXX XXXX XXXX XXXX US {$9000.00} to a Bank Of America XXXX BOA ) account which BOA had XXXX for the scammer or an agent thereof. I provided their account holder information including name, payment reference, account number, routing number and date in order to fully identify the perpetrator and the event. Also, I provided the XXXX Case ID ( # XXXX ) and the BOA Incident Report ( # XXXX ). In this prior claim I put forth XXXX questions to BOA : XXXX. Does BOA have procedures in place to properly vet their customers? XXXX. If so, were these procedures properly followed regarding the recipient of the wired scam funds, BIG EQP LLC? XXXX. Why has BOA not communicated with the XXXX XXXX with meaningful information? XXXX. If no recovery has been made, does BOA carry insurance or self insurance to protect victims of this increasingly prevalent occurrence and if so how could I, as victim, access these funds? In their response to the prior complaint, dated XX/XX/23, BOA answered NONE of these questions! Instead the response references privacy policies which do not allow them to to disclose any detailds about accounts. Although the responder wrote that she reviewed the correspondence carefully, even a simple reading would confirm that none of the questions in the original complaint inquire about details of their customer! Why couldn't the questions be answered? Furthermore, in telephone conversations with BOA personnel since the prior complaint was filed, I learned that XXXX the subject account had been frozen., XXXX there had been close to {$300000.00} of complaints against this account, XXXX initially that the account holder had " pushed back '' against the claim, XXXX more recently, that the account was permitted to be closed because the account holder DID NOT RESPOND! XXXX despite having properly filed a recall request form and " hold harmless '' letter in XXXX, XXXX XXXX asked to do both of those submittals again in XXXX. What did BOA do with the original complaint? Miscommunication and inaction on the part of BOA seems to be the only consistency. By not properly vetting their customer and not seriously considering a victims 's recall request and complaint relating to it, is BOA complicit in email fraud and wire fraud?
