Unfortunately, this is my second time complaining about this issue. I have been trying to rectify this problem for XXXX weeks now. On XX/XX/2023, I made a mobile deposit into my savings account using my paycheck number XXXX and the amount was {$440.00}. The funds were deposited into my account the next business day. This XX/XX/XXXX, I check my bank account and notice that Bank of America debited my savings account that exact paycheck amount of {$440.00} claiming that I made a duplicate deposit. Naturally, alarm bells rang inside my head because I did not deposit that check twice. So I contact my bank and get nowhere. I had to call them at least 5 times before they tell me that my SAME paycheck was deposited at another bank ( XXXX & XXXX ) which I am not affiliated with. They then proceed to tell me to contact my employer. I contact my employer and he shows me that my check was taken out of his business account when I deposited it in XXXX. It only came out of his account one time. After contacting my bank and getting nowhere, I decide to file my first complaint with the CFPB. After their first time investigating this issue, they determined that my exact paycheck that I deposited in XXXX was also somehow deposited XXXX month later in XXXX to the account at XXXX & XXXX bank ending in XXXX. CFPB told me to contact my employer again and then denied resolving my complaint. After my first complaint was closed, I discovered that the account number in which MY paycheck got deposited to DID NOT MATCH my employers business account number. So what I am getting at here is : Someone committed check fraud using XXXX of my paychecks. I contacted XXXX & XXXX bank and they told me there was nothing they could do or share because I do not have an account with them. My question is : How in the world is it policy at Bank of America to take away my money that I deposited first in XXXX because someone else fraudulently cashed my paycheck XXXX month later in XXXX? I don't understand how it is possible to get away with that when banks should be checking for identification when depositing a paper check in person. I genuinely am so bewildered and concerned that the banks are just brushing this off. Meanwhile, I somehow am getting penalized for someone who somehow got a hold of my check and cashed it ( not even sure how this is possible to begin with ). I would really hope that this raises some red flags to someone, because this just is not right. I deserve to have that paycheck funded back into my account. The reason that this has nothing to do with my employer is because the XXXX account numbers are different. There is no way that my employer deposited my paycheck because his account number does not match the initial CFPB findings. I would really appreciate if someone could help me out and give me reasonable explanation for all of this and help me get this money back because I work very hard for my money. There is no reason for it to take me this long to get back the money that is rightfully mine. Thank you.
