I have been in arrears on my mortgage for the past three years. Every time that I sent in a partial payment to catch up, it was returned to me with a letter stating that they wanted the entire amount. This happened multiple times. In XXXX of this year, I decided to try and sell the home to pay them off. I found a buyer and the house was set to close in XXXX of this year. The closing was then rescheduled to XXXX. On Tuesday, XX/XX/XXXX of this year, XXXX XXXX XXXX, the attorney for Rocket Mortgage sent an email to my attorney requesting that I make one months payment. The email was forwarded to me, and I purchased a money order in the amount of {$560.00} and mailed it to the address he provided. On Friday, XX/XX/XXXX, the payment was mailed back to me stating that they wanted the full amount. The closing date was then rescheduled to XXXX, but we did not close because the buyer did not have funding in place. On XX/XX/2023, I received a billing statement from Rocket Mortgage in the amount of {$15000.00}. The payment was due by XX/XX/2023. The closing was then rescheduled for Friday, XX/XX/XXXX at XXXX XXXX. A few hours before closing I received an email from the Buyers attorney stating that she did not have all the funding in place, but they still wanted to proceed. We did not close that date. On Monday, XX/XX/2023, I withdrew {$16000.00} from my savings account and purchased a certified check in the amount of {$16000.00} payable to Rocket Mortgage. I mailed the check priority mail through XXXX. Tracking XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Although the check was scheduled to be delivered on Wednesday, XX/XX/XXXX, records show it was delivered on Thursday, XX/XX/XXXX at XXXXXXXX XXXX On XX/XX/2023, I received a billing statement from Rocket Mortgage in the amount of {$16000.00}. On Friday I checked my Rocket Mortgage Online Account to see if the payment had been posted and it had not. On Monday, XX/XX/XXXX, I called Rocket Mortgage and spoke to XXXX. He verified that the payment was received on Friday, XX/XX/XXXX, and that it had not been applied to my account. On Tuesday, XX/XX/XXXX, I called Rocket Mortgage and spoke with XXXX. She too verified the payment was received but stated that she could not apply the money to my account. I am filing this complaint because Rocket Mortgage has been requesting payments this entire time and now that they have received it, they refuse to apply it to my account or return it. They are pursuing foreclosure instead. How is it legal to bill someone and then keep the money after theyve paid without applying it to their account? This is theft. I would like the back payment applied to my account or returned to me immediately.
