PLEASE NOTE THIS IS NOT A DUPLICATE. I HAVE INCLUDED LAW FROM THE DISTRICT OF COLUMBIA TO BACK MY CLAIMS On XX/XX/XXXX my XXXX XXXX XXXX was repossessed in front of my home. Pursuant to XXXX XXXX XXXX XXXX XXXX XXXX XXXX Prestige Financial should have sent a notice to me or my last known address 10 days prior to repossession. I XXXX XXXX, can confirm that no letter was received 10 days prior to repossessing my personal property. This is a violation of consumer rights and constitutes unfair trade practices. To further no notices prior to repossession was received as required by UCC 9. To add to this complaint, after paying the required amount of XXXX to retain my vehicle and cure the alleged debt, Prestige has stated that my account did not cure and remains in a recovery status as if payment was not received or applied properly to the account. This gives reason to believe there may be a billing error pursuant to 15 USC 1666d. I also do not receive monthly statements anymore for this account nor do I have access to the online portal. In addition I just received a notice of redemption letter for an additional XXXX dollars that is due by XX/XX/XXXX or my vehicle would be repossessed again. Prestige Financial shared my NON PUBLIC personal information with a third party to the retail installment sales contract ( XXXX ). The XXXX only includes myself, the dealership, and assignee Prestige Financial Services Inc. Since there is a binding arbitration agreement, this dispute should have been settled in arbitration prior to the company taking any actions.
