this debt collection agency that i have no relations with has been calling every week while i'm at work, I have all phone calls recorded to prove it but it will not let me upload them to this portal, they also got access to my social security number & information by committing Aggravated identity theft ( 18 U.S. Code 1028A ). I've reported them to the FTC as of XX/XX/2023, I also am reporting them to the attorney general, XXXX and also the federal reserve. I have never stepped foot in their office or did any type of consumer transaction with this company, it's gotten to the point where if they continue with this my next step is pursuing legal action against them. they say they are acting on behalf of " another company '' which is an illegal tactic. to me it sounds like they sold this company a debt and now they are trying to ''collect '' said owing 's from me. they are a debt collection agency so i'm sending my debt validation demand through the portal so the CFPB can act as a third party witness. THIS IS THE EVIDENCE OF A DEBT I REQUIRE THEM TO SEND ME : Provide me with the production of the account and the general ledger statement. send me verification of your claim against XXXX XXXX, that is, a signed Invoice. provide me with a copy of the Contract binding both Lockhart , Morris & Montgomery , IncXXXX & XXXX XXXX and send that letter by recorded delivery so that there is an independent witness to it having been delivered. provide me with a statement admitting whether you are the holder in due course or whether you are a servicer. provide me with a statement admitting whether you have sold my note in a pooling and servicing agreement. This is also known as securitization. provide me with the identity of the true holder in due course for my loan. If the loan has been securitized, provide me with the name of the XXXX my loan was sold to. provide me with the XXXX number under which my loan was securitized to. Make available for visual inspection my original wet ink promissory note ( not a photocopy ). Please provide the above and If you are UNABLE to provide this proof as I have requested within 30 days, then you admit to not being a party of interest and can not rightfully enforce your eviction claim under U.C.C - ARTICLE 3 3-301. Under US Code TITLE 15 > CHAPTER 41 > SUBCHAPTER V > 1692g part ( b ). this debt is now officially in dispute. as of XX/XX/2023 I have no collection account from Lockhart , Morris & Montgomery , Inc. reporting on any of my credit files. By law, ALL COLLECTION ACTIVITIES must CEASE that includes reporting any negative reporting to any credit bureau until this matter is resolved. You are hereby given notice. Blatant disregard for this law is subject to multiple fines by the FTC. In the event that this debt is not validated by you, as required by the Fair Debt Collections Practices Act, you have a legal responsibility to terminate the claim and correct any credit reporting which XXXX have been made in connection with this alleged debt.
