XXXX # XXXX Pursuant to the Fair Credit Billing Act, A creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose. This account is a billing error. This is not a refusal to pay but a notice that this alleged debt is disputed. If no such evidence of indebtedness exists, and the only indebtedness is by agreement, you can not lawfully furnish this inaccurate negative information to the credit reporting agencies. The United States is bankrupt. If this alleged debt is valid, what authority do you have to collect this debt in the United States? If this alleged debt can not be validated and turns out to be an extension of credit, that would make the negative information provision in any agreement between us void and unenforceable. Does this account include a finance charge? If so, does the finance charge include a premium the protects the creditor in case of default? Has any insurance been filed on this account? If a 1099c or any insurance has been filed on this account, you have no right to continue furnishing this inaccurate information to coerce repayment of this extension of credit. The continued reporting of this inaccurate information would constitute a breach of fiduciary duty.
