Began discussing loan modification options around XXXX of 2022 and advised we could either put delinquent amounts on the end of our loan or add to loan with increased interest. We declined the latter and in XXXX and XXXX of 2022 received modification paperwork which increased our interest rate from XXXX XXXX XXXX XXXX XXXX, increased payment by $ XXXX and seemingly adds total amount past due to principal balance which would change from XXXX to XXXX. Told this or paying off the loan was our only option. Received notice dated XX/XX/2022 that we had until XX/XX/2022 to discuss options to avoid foreclosure but home auctioned off on XX/XX/2022. We had no idea this could or would happen as we were actively attempting to find resolution. Unsure at this time if sale will stand and we will be evicted, and forced to file XXXX XXXX XXXX immediately. Towards the beginning of XXXX told we were on 180 day forebearance, later told we werent and denied our request for forebearance stating unnecessary. On XX/XX/2022 told by phone all available forebearance used but we believe a 90 day forebearance was only utilized/requested 3 times. Told we had to reapply for forebearance after 90 days. Required to fill out extra information to qualify for forebearance. We believe dual tracking occurred and loan modification and foreclosure were happening simultaneously. Spoke with representative in XX/XX/2022 to notify of our intent to apply for XXXX and asked for confirmation of forebearance. Lead to believe we were on forebearance. We believe forebearance and XXXX postponing foreclosure date were used interchangeably. We question accurate reporting to credit bureaus, assessing late fees while in forebearance, and level of deception that occurred overall. Due to our home being auctioned off we felt it more important to initiate complaint and not wait to look through all correspondences for other incidents.
