I filed a CFPB complaint on XX/XX/XXXX case number XXXX requesting documentary evidence of this alleged debt between GM Financial / General Motors Financial Company/ General Motors , XXXX AmeriCredit XXXX XXXX, XXXX XXXX XXXX etc. and XXXX XXXX. After further review of the documents sent to me by GM Financial, I discovered fraudulent activity. Please note of my findings : 1. A {$500.00} down payment was accepted by XXXXXXXX XXXX XXXX as no cash payment shall be included in a credit transaction per Truth in Lending. The {$500.00} dollars was added back to the Total Sale Price. 2. The contract stated in clause f we will sell the vehicle if you do not get it back. If you do not redeem, we will sell the vehicle. We will send you a written notice of sale before selling the vehicle. The consumer never received a written notice of sale from GM Financial. However, Consumer has documentation that no letter was delivered to XXXX XXXX XXXX. According to O.C.G.A. 10-1-36 when any motor vehicle has been repossessed after default in accordance with Part 6 of Article 9 of Title 11, the seller or holder shall not be entitled to recover a deficiency against the buyer unless within ten days after the repossession he or she forwards by registered or certified mail or statutory overnight delivery to the address of the buyer shown on the contract or later designated by the buyer a notice of the sellers or holders intention to pursue a deficiency claim against the buyer. 3. On the application from XXXXXXXX XXXX XXXXXXXX, consumer birthdate is wrong the application has XX/XX/XXXX however consumer birthdate is XX/XX/XXXX. The signature is not consumer signature. If you note on all pages the consumer does not sign name as such. 4. On the assignment to retail installment contract, there is not date of contract between seller ( XXXX XXXX XXXX XXXX XXXX ) and buyer ( XXXX XXXX, XXXX XXXX ). Nor is there a signature between Dealer-Seller and AmeriCredit has state on assignment. Only one signature.
