Servicing of the mortgage transferred from XXXX to Rushmore effective XXXX XXXX, 2022. As of XXXX XXXX, 2022, borrower had not been informed of the servicign transfer so borrower made a regular monthly payment of {$540.00} to XXXX. XXXX put that payment into suspense, then on XXXX XXXX, 2022 XXXX transferred that payment to Rushmore. Rushmore did not apply that payment to the loan account, but instead applied it to the escrow account. There was no justification for Rushmore to apply this payment to the escrow account which was not short. The wrongful application of this payment put the loan into default and triggered the imposition of late fees and letters from Rushmore to the borrower wrongfully asserting that the loan was in default.
