I applied for a loan modification and a file was completed 37 days before the sale date. A representative from Rushmore took a personal interest which was negative and denied the file while we were on the phone with him. He was stating there was one item missing. We called back the same day and sent the document to a supervisor who stated the file never should have been closed and she would try to reopened it, which she was unable to do. The representative who denied the file is XXXX XXXX XXXX he was very rude and denied the modification stating we were under 37 days, although this was not true it was day XXXX. We then filed a complaint against representative. The supervisor stated they will call me back to let me know if XXXX supervisor will reopen file and stated it was denied in error. Our complaint also stated to remove XXXX XXXX from the file. He was no removed. We went to court to have the court move the sale date which was approved and we submitted the loan modification a second time. XXXX XXXX failed to even open the file until after the 37 day rule had passed, making us ineligible for a review. This is unfair how one representative with a bad attitude and a need to hurt others should be allowed to make a decision that no one can fix.
