I have disputed this on more then one attempt and CFPB closed account without investigating my complaint against IQ Data international false claims. CFPB states that A debt collector may not collect any interest or fee not authorized by the agreement or by law. The interest rate or fees charged on your debt may be increased if your original loan or credit agreement permits it and no law prohibits the increase, or if state law expressly permits the interest or fee. I have argued this fact in my previous statement and nothing has been done about this false claims by this debt collector. I have not agreed nor signed anything agreeing to a third party interest or any kind. IQ Data international states in this letter stating under the CFPB Consumer Financial Protection Bureau XXXX XXXX XXXX Iowa XXXX, IA XXXX Re : Complaint of XXXX XXXX Case Number : XXXX and XXXX Internal Reference : XXXX We have received your dispute letters of XX/XX/XXXX and XXXX, XXXX, in which you dispute the interest charges on your account in our office. We collect amounts owed to rental properties, and our records reflect your account was placed with our agency on XX/XX/XXXX, to collect {$640.00} owed to our client, XXXX XXXX. Initial notification, with instructions to dispute or make payment, was mailed on XX/XX/XXXX to the addresses submitted by our client which was unfortunately returned as undeliverable. Our office again mailed notification to your updated address on XX/XX/XXXX. Our office disagrees with your assessment regarding charging interest. Your account is accruing interest of 7.00 % per annum as allowable by law. This interest rate was disclosed in your initial notification. Under what Law is this allowed under Fair Credit Act? Under the 807. False or misleading representations. A debt collector may not use any false, deceptive, or misleading representation or means in connection with the collection of any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section : ( 1 ) The collection of any amount ( including any interest, fee, charge, or expense incidental to the principal obligation ) unless such amount is expressly authorized by the agreement creating the debt or permitted by law. IQ Data has been sued for this same Tactic more then XXXX times. I request this company provide proof they are entitled to this false claim stating I agreed to this debt or even signed any agreement stating I agreed to a third party interest fee. CFPB failed to investigate this false claim and I have been asked by my legal counsel to try again. If this complaint can't be resolved I will be moving towards legal matters suing both CFPB an IQ data international
