I'm writing this complaint to address a response that I received from chase bank via mail. I submitted a complaint to the CFPB about Chase Bank obtaining my consumer report without a permissible purpose or consent from me the consumer. this is my final attempt to settle before I escalate this matter to arbitration. Chase Bank has in fact admitted to being guilty of XXXX count of obtaining my consumer report under false pretenses and without consent from me the consumer. CHASE BANK obtained a copy of my consumer report under false pretenses I never gave them written consent to obtain my consumer report. On XX/XX/2021 they pulled my consumer reporting causing my score to drop tremendously. They used my identifying information without my consent to obtain a copy of my consumer report from XXXX. chase bank committed identity theft pursuant to 15 usc 1681 ( a ) ( q ) ( XXXX ). The term identity theft means a fraud committed using the identifying information of another person, subject to such further definition as the Bureau may prescribe, by regulation. Pursuant 15 USC 1681q, Any person who knowingly and willfully obtains information on a consumer from a consumer reporting agency under false pretenses shall be fined under title XXXX, imprisoned for not more than 2 years, or both. CHASE BANK ( JPMCB CARD SERVICES ) obtained my consumer report under false pretenses and without written consent and have admitted to this crime in their response to my complaint and they shall now be held liable. They responding letting me know that they asked the CRA to update the inquiry on my report, but there still was no permissible purpose or consent given to them from me the consumer to obtain a copy of my consumer report. they were supposed to conduct a permissible purposes audit but have failed to do this and provide me with any results. This unauthorized inquiry damaged my consumer report and they are now Criminally and civilly liable. Pursuant 15 USC 1681n ( B ) in the case of liability of a natural person for obtaining a consumer report under false pretenses or knowingly without a permissible purpose, actual damages sustained by the consumer as a result of the failure or {$1000.00}, whichever is greater ; chase bank is in violation of 15 U.S. Code 1681q and 15 usc 1681b ( XXXX ) and 1643 of this title unauthorized use of a credit card which is defined as my social security number. under title 15 usc 1602
