As of XXXX, XXXX, Rushmore Loan Management Service LLC ( RLMS ) made unauthorized payment to DC XXXX XXXX. On XX/XX/XXXX, I forwarded via text and email, the letter I received from the tax authority deferring my payments to RLMS. They acknowledged receipt and did not forward payment in XXXX of XXXX, and XX/XX/XXXX, when bi-annual Property Tax payment come due. However, in XXXX of XXXX, they did not adhere to the XXXX and paid the tax. After I was made aware of the error, I phoned DC XXXX XXXX to seek instructions as to how to retrieve RLMSs unauthorized payment, they gave them to me, and stressed I could not file for the refund myself, it had to done by RLMS. Therefore, I forwarded it to RLMS every way available, phone conversation ( s ), email, text, and through their internal database, to give the instructions as to how to have those unauthorized taxes paid, returned to them. Apparently, they had chosen not to follow instructions for months. RLMS finally posted the refund XX/XX/XXXX, XXXX ( XXXX ) months later, from XXXX for {$2400.00} and recorded an Escrow overage, in RLMSs procession of {$1400.00}, totaling {$3900.00}. Every time I called them to try and resolve this problem, they seemed to understand the situation, and I was told it was being researched and processed. However, I receive ( d ) " robo '' calls, since XX/XX/XXXX, and to this day, at a minimum of once a day, to as much as XXXX ( XXXX ) time a day, harassing me about a simple matter they had been instructed on how to resolve in XX/XX/XXXX. During the last conversation I had with their representative in their XXXX XXXX XXXX XXXX, ( which should be recorded, as well as all the other calls ) I told her of my fear that RLMS would take the actions, since it has taken RLMS so long to resolve their problem, and make it mine. She informed me that would never happen because this was not an issue of a late or non-payment of mortgage due, and could not be reported as such by RLMS. But RLMS did just that, XXXX ( XXXX ) times. In XXXX, XXXX and in XXXX, where by this time they have received {$3900.00}, and posted a late payment in my credit history with the Credit Reporting Agencies. A late mortgage loan payment report is an aggregate of the moral qualities which belongs to and distinguish an individuals person. The moral predisposition or habit or ethical qualities, which believes to be attached to a person, on the strength of common opinion and report concerning me. Although character and reputation are not synonymous, reputation, is what I am reputed to be, an estimate of what society has and renders unworthy of belief. In this instance, whether I will pay my bills ( Mortgage ) on time. This was done with knowledge and forethought, especially after the first falsified report to the Credit Reporting Agencies was made. RMLS has placed my mortgage loan account in the rears as a way of justifying RLMSs claims of owing non-mortgage fee payments, and falsifying a post for a 3rd time with Credit Reporting Agencies. As per a letter, to XXXX XXXX, dated XX/XX/XXXX re : XXXX XXXX XXXX, the total net amount due is {$110000.00}. I paid {$1100.00} on XX/XX/XXXX and {$1100.00} on XX/XX/XXXX, yet I can't close on my refi because RLMS is saying I owe XXXX 's mortgage. I have been trying to refinance all of XXXX. My current rate with RLMS is 4.375 %. I locked in in XXXX 2.65 % ( XXXX Mortgage ) and lost that because of RLMS. Ive applied and locked in with another refi company ( XXXX ) and RLMS is blocking that effort, by misrepresenting my indebtedness to them. I will pay, under duress, whatever outstanding fees claimed due by RLMS, so as to not lose my locked in refinance interest rate, before it expires.
