On XX/XX/XXXX, I wrote a check ( # XXXX ) in the amount of {$1200.00} On the same day, I put a STOP PAYMENT on the check. On XX/XX/XXXX, the bank paid out on the same check ( # XXXX ). On XX/XX/XXXX, I walked into my branch ( Bank of America XXXX XXXX ), and spoke to the branch mgr. I explained the situation. I told her that I was surprised that the check was paid by the bank. Her response was, " it should not have been paid for 2 reasons ; 1 ) its a stale check and 2 ) a stop payment was put on it '' With me in the room, branch mgr called customer service. She was surprised to hear that STOP payments expire after 6 months. And checks do not go stale. She was very surprised. And I was too, of course. I was not informed that STOP payments expire. Also, the check was presented months earlier, and block by the bank. So the thief waited for the STOP payment to expire. I was not notified that the check was presented earlier easier.
