ChexSystems is in NONCOMPLIANCE of the Code of Federal Regulations, Regulation V and the Fair Credit Reporting Act, FCRA. I am a victim of identity theft pursuant to 12 CFR 1022.3 ( h ). A fraud has been committed against me by using my personal identifying information. I have previously reached out to XXXX XXXX in regards to this fraudulent account and they told me to reach out to ChexSystems. ChexSystems is now making me a victim of their violations to federal law. I sent ChexSystems my official Federal Trade Commission identity theft report, proof of my identity and proof of my address on XX/XX/XXXX through USPS certified mail. XXXX received my documents on XX/XX/XXXX. According to the FCRA 15 USC 1681c-2, ChexSystems is required to block this fraudulent account no later than 4 business days after they receive my correspondence and they have 5 business days to advise me they decline to block this fraudulent account. It has been 10 business days and I have not received any correspondence from ChexSystems regarding this matter. ChexSystems is in Noncompliance of Federal Law and their Code of Federal Regulations. I, as well as Federal Regulators expect ChexSystems to abide by the instructions and requirements of the Fair Credit Reporting Act and their Code of Federal Regulations. Is ChexSystems above the federal laws they have to abide by? Is ChexSystems above their Regulators who have put the Code of Federal Regulations in place? This identity theft is hendering my progress in life but the federal laws are here to protect me and my rights. However, ChexSystems refuse to follow those laws.
