On XX/XX/2021, Bank of America refused to honor a valid negotiable instrument drawn on it in violation of UCC Sec 3-104. Initially, the bank refused to cash the check. I then requested that the bank issue a Teller 's check in replacement of the check I was given, in accordance with Associated Carriages , Inc. v. International Bank of Commerce. The bank still refused to comply. I told Mr. XXXX XXXX XXXX, the Financial Center Manager, that the Bank 's refusal was illegal according to the UCC. Mr. XXXX told me that I would have to speak with a bank attorney, to which I agreed. However, then Mr. XXXX insisted that I leave the bank, without permitting me to speak with the bank 's attorney. The only legal exception to UCC Sec 3-104 is if the bank has doubts over the identity of the payee. As I requested a Teller 's Check in the same Payee name, such a defense is not valid here.
