Consumer Narrative
On Sunday XX/XX/XXXX I signed a loan agreement to purchase a used XXXX XXXX XXXX for {$27000.00} at XXXXXXXX XXXX XXXX XXXX located at XXXX XXXX XXXX XXXX XXXX, NY XXXX. I put {$500.00} down on the car and financed the remaining {$27000.00} with Chase Bank. Upon test driving the car I found that the air conditioning was not working. I informed the representative of this and I was assured it would be fixed before the car was ready to be taken off of the lot. After the paper work was complete I was urged by the finance representative to take the car off of the lot and bring it back to be services. I then said I do not wish to drive a car that I just purchased that does not completely work. I was then told by the representative to leave the car at the dealership for 48 hours and they would have it serviced and repaired for me, free of charge. On Tuesday XX/XX/XXXX I return to the dealership to finally drive the car off of the lot and I was told that the car was not ready and they did not have a rental car that I could used until the car would be ready. after this inconvenience I moved to remove myself from this agreement due to the face that the car must've had more problems than originally mentioned by the dealership, and the amount of time it was taking too receive the car. After two days of talking with the dealership about possibly removing myself from this loan they were not compliant. On Thursday XX/XX/XXXX, XXXXI decided to call the bank that the loan was registered to, Chase Bank. They informed me that at that time there was no loan submitted to them in my name. I communicated to them that the dealership was trying to sell me a car with more problems that originally stated and I wish to no longer proceed with this loan agreement. They informed me that the process of cancelling a loan agreement could be initiated by them once the loan information was processed however, a cancellation could only confirmed by the dealership. On XX/XX/XXXX I spoke to an auto loan representative of Chase bank named XXXX. XXXX opened up a case in hopes of having the dealership cooperate with the bank and myself with canceling the loan. I still had not taken possession of the car, In fact I haven't even seen the car since XX/XX/XXXX. Between the days of XX/XX/XXXX and XX/XX/XXXX I visited the dealership again in hopes of coming to a resolution. I was informed that the car was still being serviced at this time. Once again, I informed the dealership that I was not taking possession of the car because I wish to not purchase this car anymore due to the clear abundance of problems. The dealership told me that I test drove the car on XXXX, XXXX and that is legally taking possession. During the test drive the car had license plates that belonged to the dealership. The car was also under the insurance of the dealership, so I was confused as to how they viewed me test driving that care as taking possession. I was also told that by the dealership that if I did n't drive the car off of the lot they would deliver the care to my home and leave on the street. I was told by the bank that an investigation have been preformed on XX/XX/XXXX. Chase Bank told me that the dealership told bank that I took possession of the car on XX/XX/XXXX and brought it back to the dealership on XX/XX/XXXX to be serviced. This information was incorrect, nor did it make sense. To date I have not made any payments on this car. I also have not taken possession of this car. In fact I still have not seen this car since XX/XX/XXXX. This dealership has spread lies about the events that took place and continue to not work with me on the matter.
