We planned to develop and prototype a mobile app during the pandemic. We engaged in a conversation with XXXX XXXX and their promise to deliver a functional prototype based on our business requirements. We agreed to work with XXXX XXXX on terms detailed in our email communications. XXXX agreed to build a functional prototype for a fixed rate. I submitted all available documents we had previously created and developed for their review and evaluation, including the functional flow chart, product description in XXXX, executive summary, and XXXX and XXXX mock-ups. XXXX XXXX, operation manager at XXXX XXXX, assured me they can start right away and directed me to sign in online and to select the product at {$2400.00} and they will build a functional prototype/mobile app by mid-Summer. Per XXXX XXXXnstruction, I signed in online and paid {$2400.00} with my Chase Visa on XX/XX/XXXX, with an agreement with XXXX to deliver a functional prototype by Mid Summer. I have attached the email communications with XXXX XXXX to this letter to support my requirements for your review and files. I supplied all the documents I had created to assist them in preparing a proposal for a fixed rate. But, I received a preliminary design in PDF format and a contract with different terms than I had agreed with XXXX on XX/XX/2021. Thus, I objected to the proposal and the terms and refused to sign the contract. I have attached the proposal to this email for your review. I did not sign nor agree with the terms in the proposed contract. Then, XXXX XXXX XXXX XXXX XXXX responded that his operations managers letter meant something different XXXX was saying we are happy to give a fixed scope contract. In order to do so, we need a very FIXED feature list and timeline from you. Anything outside of the fixed feature list will not be covered in the fixed contract. In addition, we will not bill any amount above that as well... I responded that we had agreed to develop a functional XXXX and prototype it with existing assets to create a story and engage interest. Time is running out and, for us to continue, I request that XXXX XXXX conclude the requirements and launch a functional prototype for a fixed rate as per our agreed timeline. I sent an email on XXXX XX/XX/2021, at XXXX XXXX. But a couple of days later, XXXX responded that to set up a meeting to come to a solution. I then decided that XXXX XXXX could not deliver on my requirements as promised, and they wasted my time with incompetent design and proposal. I sent a letter of cancellation on XX/XX/XXXX that I would not sign the contract and would not continue with XXXX XXXX based on their submission. I requested a refund for the deposit on XX/XX/2021, email. XXXX XXXX refused to refund me and I disputed with my Chase credit card issuing bank. Unfortunately, XXXX XXXX fabricated an unapproved design and hosted it on XXXX, two weeks after I canceled the project with them on XX/XX/2021. They sent me a link on XX/XX/2021 ; after two weeks of cancellation notice and provided to Chase as a supporting document that they have delivered the product on time. Chase errored to investigate this scam properly and decided incompetently without investigating the products functionality.. Chase Banks representative sided with the scammer and declined my dispute request d and paid XXXX. They claimed they had sent me a letter, and i failed to respond to their inquiries and provide documents on time. I never received that letter,. I am flabbergasted with their assertions. I am reaching out to FTC for help to protect consumers from Internet scammers such as XXXX XXXX. I request FTC to investigate this unauthorized charge and issue directive to Chase to refund my money.
