Over the past three months servicer of the loan has delayed posting of payments. I have had many calls from this company stating that payment was not received only to find out after a new payment was sent that the check was cashed. In XXXX of this year I was told that a payment that was sent was not received by my loan servicer. I stated the payment was mailed to them in late XXXX so they should have the payment by now. I was told that it could take a day or two for the payment to post to my account. A few days later I was called again and told that the payment has not yet posted to my account and that I was now late. I then sent in a payment to not only cover this payment but the current months payment as well. Two days later I was notified by my bank that the first payment cleared my account. After the first check cleared I then put a stop payment on the second check. I informed the company that a new payment for the current month would be sent and a stop payment would be placed on the second check with my bank. Two days later an attempt was made to cash the second check. I was able to contact my bank to have this payment stopped. I was told by my bank that the reason why the second check posted to my account was due to the company not posting the e-check based on the check number listed in my original stop payment. The company left off the first 4 digits of the check and only used the last 2 numbers of the check number to process the payment. Then a few days later I received a letter from the company stating I owed them a return check fee and late payment fees. I contacted the company again and informed them not only was I not paying these fees but I was owed {$25.00} for the stop payment fee placed on the second check. No other communication occurred between the company and myself over this certain issue. The new payment to cover the amount that was still unpaid was sent to them via priority mail and received by the company on XX/XX/XXXX. I now have received calls stating that the payment was not received but then this changed to the payment was received but was returned NSF as of XX/XX/XXXX. I told the company that I was not aware of the non payment of the second check. That I would contact my bank to verify this issue. In contacting my bank I was told there was enough funds to cover the amount still unpaid and that there was no evidence of any return items on my account. I contact the company again and told them this. The representative I spoke to could not respond to why the check was returned as NSF or provide me with any other information showing an attempt was made to process this payment. The only thing I was told is that I am now required to make my payments electronically. Which I refuse to do since I have had my banking information compromised on more than one occasion with others companies but I must as the company is now threatening to repossess my car unless I pay them now. So now I have to place another stop payment on a check and allow my account to be drafted, one time only I am told, to have a vehicle for my family. I think this company ( Consumer Portfolio Services ) is doing this and forcing me and their other customers to only pay via electronic methods. They are doing this in an attempt to lessen their overall cost and force customers to comply to what is best for them.
