I bought this car with my ex husband back in XX/XX/XXXX. 2 years later we got a divorce and the car was rewarded to me in the divorce leaving my solely Responsible for the debt thereon to prestige and or any payments which may Become due for the use operation and maintenance or financing of said vehicle and shell hold her husband harmless from any of the cost there on. That statement was directly quoted from the divorce papers. That statement has never happened. I have tried many times to make it possible to make me and only me solely responsible for the vehicle even though I have been the only one to pay the payments, maintenance and tag renewal of the car. The current situation I am in is I have moved stages, from XXXX to XXXX, where I am currently trying to get the car titled. The issue that I am having is that the state is stating that he has to be present or sign a power of attorney paper, which he is refusing, for me to be able to transfer the vehicle. Due to the information in the divorce decree, this statement should not apply to my situation. The car company i.e. the loan company, has stated to me that not only is the divorce decree invalid in regards to getting this information changed but will not be changed even if the car is paid off. With this being said I am now unable to get the car licensed tagged and or updated in regards to the tags for the state of XXXX. I am unable to do this because of them being unwilling to follow the divorce decree which has been filed and processed to the state of XXXX. Along with the information stating that I am financially responsible there is also information in divorce decree that states, the husband shell execute any title or transfer documents, if necessary, pursuant to this agreement.. Based off of the last bit of information that I was informed of, my ex-husband is still getting information from this company, prestige, about every payment I have made from the time of the divorce thats up until the most current. I have recently tried to contact the car company to ask for any and every advice they might have. I have called on : XX/XX/XXXX, XX/XX/XXXX XXXX, XX/XX/XXXX XXXX, XXXX. I have received no responses from the attempts I have made to the loan company. I now have expired tags that I can not update due to him having to be present, or sign the paper he refuses to sign, and has me unable to XXXX by state laws. I would just like the car to be solely mine like the court order states so I can transfer the car and move on with my life.
