After reviewing my credit report and noticed that my credit report had old, outdated information. The specific item in question is a Mortgage entry in my credit file. On the report this entry is listed as closed by Bank of America. Including the following information, the date of last activity which was XX/XX/XXXX, date it was reported XX/XX/XXXX and the date when the account was closed which was XXXX of XXXX. Based on this information on my credit file and my understanding of the Fair Credit Reporting Act which states credit bureaus are to automatically delete old outdated negative items from credit reports, I asked XXXX to remove the old outdated information from my file. On its website XXXX states the following closed accounts stay on your credit report for up to ten years from the date of last activity. Since the last activity date on the item in my credit file was XX/XX/XXXX which is which is 11 years well beyond the time allowed by law to remain on file. I asked XXXX to remove the old outdated information from my file however as of XX/XX/XXXX they refused to remove the information. XXXX stated they contacted Bank of America and they stated the account listed on my file was still open and when I asked XXXX stated BOA did not provide any additional information. At this time I questioned how BOA reported the account closed on XX/XX/XXXX but now BOA is now saying the account still open. I asked the XXXX employee XXXX XXXX XXXX regarding the discrepancy on Bank of Americas reporting. I argued that the account on my file was already reported closed in XXXX which she herself confirmed after doing research on my file. I asked if they would do any additional investigation into this matter. I questioned the fact of how after reporting the account closed back in XXXX, BOA is now saying the account is still open and her response was sir it doesnt work that way. We dont do any additional investigation we just report the information we get back from them, I asked wether the info was right or wrong and her response was we dont verify anything we just report the information we get. This is outrageous. 1. XXXX has not been in compliance by failing to automatically delete old, obsolete, and outdated information from my credit file. 2. XXXX rubberstamps into consumers files incorrect information provided to them 3. BOA listed the information I wanted removed from my file as closed 8 years ago and the last activity took place in XXXX of XXXX. 4. BOA reported to XXXX the item in question on my credit file is not closed but rather is currently open.
