Sent from my XXXX Begin forwarded message : From : XXXX XXXX XXXX Date : XX/XX/XXXX at XXXX XXXX EDT To : XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX, XXXX XXXX XXXX Subject : Third complaints to FTC and FCPB against Rushmore, XXXX XXXX XXXX XXXX and Attorney seeking to illegally sell on sheriffs sales based on the judgment obtained for XXXX XXXX, not Rushmore and XXXX XXXX XXXX XXXX Dear OIG/Ombudsman , Rushmore , XXXX XXXX XXXX and their Attorney are engaged in serious Bad faith business practice knowing that once the disputed sheriffs sale happens on XX/XX/XXXX, I might not have the opportunity to expose the fraudulent act they are practicing. I dont have any mortgage with XXXX XXXX XXXX XXXX Rushmore client. The attorney on XXXX obtained a judgment on behalf of XXXX XXXX for the about {$25000.00} HELOC I owed to XXXX XXXX XXXX from XXXX through XXXX when my bankruptcy was active. XXXX XXXX XXXX sold the HELOC loan to XXXX XXXX and serviced by XXXX XXXX. XXXX XXXX attorney filed a foreclosure action and obtained default judgment of the principal, interest, fees, insurance charges, penalties totaling about {$43000.00}. I filed appeal to request a new trial but the attorney proceeded to sell the property in sheriffs sales. Suddenly, Rushmore LMS communicated with me and claimed to represent XXXX XXXX XXXX and began to classify the judgment amount as mortgage. Rushmore put together similar charges already part of the judgment amount as amount owed. Rushmore continue to create accounts and charges legal fees etc and currently demands a payoff amount of over {$63000.00} and reinstatement quotes of about {$4300.00}. Meanwhile the reinstatement copy attached was the previous stated showing {$34000.00} due on XX/XX/XXXX and I paid XXXX towards the judgment amount but it was rejected. For about 2 months ago, I have been requesting for a statement of the said amount. No statement has been requested. Their reason is that the attorney assured them that the last date to sell the property ordered by the court is on XX/XX/XXXX. Until now, I am making this complaint no statement has been received. However, I have offered the amount of {$43000.00} to pay the judgment amount but the referred to it as reinstatement. I have been waiting to receive the account statements demonstrating how Rushmore LMS got about {$63000.00} or reinstatement amount requested. Believe me, I have never experienced the types of business practice like I am currently facing. The attached proof of cashiers purchased to confirm willingness to pay as soon as I receive the detailed statements showing how you determined a total amount of {$63000.00} you are demanding. Otherwise, I will file a lawsuit bad faith and unfair business practice that has caused me to seek medical attention for the psychological and emotional pains I am currently facing. I intend to seek damages for the suffering and punitive. I look forward to hear from you before the sheriffs sales date scheduled for XX/XX/XXXX not for XXXX XXXX but XXXX XXXX XXXX unknown to me. Rushmore sent letter attached here promising to address my concerns meanwhile sheriffs date is set for XX/XX/XXXX. Reinstatement amount as at XXXX was {$34000.00} ; in XXXX the reinstatement amount demanded is {$43000.00}. How and why almost {$10000.00} difference? No statements provided.
