After looking at my consumer report I noticed a collection I did not recognize and wanted to address. On XX/XX/2021 I sent a letter to the collection agency in question. I simply sent a letter asking for a validation of debt so that I can understand this consumer transaction. After sending my letter to XXXX XXXX XXXX XXXX XXXX they sent me a summons with multiple letters saying I was being sued. This letter terrified me because it stated that the paycheck I use to feed, clothe, and house my family with will be taken away from me to pay a debt alleged to be mine. After reading over the fair debt collection practices Act I noticed that this could be a violation pursuant to 15 USC 1692d ( 1 ) but I'm not sure. I also saw some other possible violations that I wasn't sure applied to me, I wrote them on the exhibits attached. The only thing I ever wanted from initially reaching out about this debt was to gain clarification and fulfill my obligiation whatever that may be. And this company immediately started attacking with this lawsuit alongside XXXX XXXX XXXX XXXX XXXX who is acting as this debt collectors attorney. This letter was recieved by me on XX/XX/2021 and the court date is scheduled for XX/XX/2021. I was not given enough time to respond to the letter appropriately or even get an attorney together to help represent me. I feel like I am being set up for failure. I think this is also a violation of 15 USC 1692g ( d ) and 15 USC 1692e ( 7 ) but again I am not sure and wrote the rest on the exhibits attached.
