I requested the following documentation as stated below directly from GM FINANCIAL. On XX/XX/2021, I received a response. A copy has been provided. I have also included a copy of the letter I sent GM FINANCIAL. They failed to send me the requested copies of the documents that are required by law. ***************************************************************** Under the laws of the State of Texas UCC statutes a deficiency can not be claimed unless all of the required notices were properly and timely given, and all of the allowable redemption and cure time limits were adhered to. Please provide proof that the repossession of the subject vehicle was legal in accordance with the following State of Texas UCC : 9-611. NOTIFICATION BEFORE DISPOSITION OF COLLATERAL 9-612. TIMELINESS OF NOTIFICATION BEFORE DISPOSITION OF COLLATERAL. 9-613. CONTENTS AND FORM OF NOTIFICATION BEFORE DISPOSITION OF COLLATERAL Since no proof was submitted, this claim of a deficiency is null and void, and any continued collection activities, or continued reporting of this invalid claim on my credit reports will be considered a violation of the FDCPA and FCRA.
