in XXXX of XXXX i was given a HELOC by Washington Mutual bank Interest Only for a maximum loan amount of {$100000.00}. I paid on the loan, paying some on the principal of which i had problems with the bank applying all payments to my account. I received the amount in 2 payments $ XXXX {$55000.00}. XXXX, XXXX the bank realized they had made a mistake in issuing the full amount to me, they had no instrument to collect any fees or interest, and at the time unknowing i signed a loan modification for an additional {$50000.00}, amount i never received, to cover fees and interest rates. I had to do a loan modification after Chase bank took over Washington Mutual due to accelerated interest rates on credit cards and the modification included a deferred amount of {$79000.00} plus an unpaid balance of approx. XXXX which i am currently paying. I am requesting Chase to either absolve the deferred amount or allow me to negotiate it down so that i may have the ability to refinance my current mortgage at a lower rate as i would like to remain in home. I am XXXX XXXX XXXX on a fixed income and it is a hardship for me to try and continue to be self sufficient. As i have been advised by Chase if i don't pay the HELOC my home may end up in foreclosure, even though it was discharged in bankruptcy 10 years ago
