It's very simple. When you buy a plane ticket and pay for luggage, delivering the luggage without stealing destroying or losing it is part of the contract. My luggage was destroyed. By international law the airline is responsible for this, but also by basic contract law. Part of what I paid for was to deliver the luggage to the final destination undamaged. They failed. The credit card company illegally charged me for the service that was never completed. The airline tried to replace the name brand designer luggage with some cheap XXXX XXXX type luggage in horendous colors instead of paying for this. When I pointed out this is not in accordance with teh law, the refused to rectify this. The credit card company colluded with the airline to make me pay for this illegal contract.
