My wife and I are XXXX XXXX. Who assumed our conversation with Rocket Mortgage were honest and accurate. They removed my access to the account. Mortgage Fell behind in XXXX XXXX due to Bank error/Closing. yet bank did not infom us, about any attempt by Rocket Mortgage, nor XXXX, Acct was closed ( we discovered they were mailing out checks to XXXX up until XX/XX/XXXX ) They denied me access after I submitted everything I Had ... On Phone they told me to give it time for them to review. I was not confirmed as XXXX until XX/XX/XXXX. Rocket Morgage websie even denied access for uss to apply for XXXX XXXX XXXX Damage XXXX XXXX XXXX I had to wait and Foreclosure Letters started coming in mail .. I thought they were scams, as we have received many others, before and since. 2 Full Monthly Payments Made by us were Never accounted for. We were informed by neighbors that our home was listed for foreclosure sale. XX/XX/XXXX We got help from XXXX XXXX XXXX who wrote the following on our behalf and got sale postponed until XX/XX/XXXX.. They call this " Dual Tracking '' a mortgage. Where reps ar Rocket are telling us one thing .. * I'd like to attach the XX/XX/XXXX statement and ask you to find mention of foreclosure. Itt simply states Pay by XX/XX/XXXX. Meanwhile we received a response to our lawyer. It has so much ( deliberately incorrect information, They should be charged with Fraud. XXXX XXXX XXXX XXXXXXXX XXXX XXXX Of Course they may have been given the erroneous info by their client.. I am certain you already have their name .. XXXX, MI XXXX Via regular mail Rocket Mortgage , LLC XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, WV XXXX via Certified Mail, Return Receipt RE : Notice of Error by Successors in Interest XXXX XXXX and XXXX XXXX XXXX / Appeal of Denial dated XXXXRequest to Confirm Successor-in- Interest Status Loan Number XXXX Property Address : XXXX XXXX XXXX XXXX, XXXX, WV XXXX To Whom It May Concern : Please treat this letter as ( 1 ) an appeal of a loss-mitigation denial under 12 C.F.R. 1024.41 ( h ), ( 2 ) a request to confirm XXXX XXXX XXXX and XXXX XXXX 's status as successors in interest under 12 C.F.R. 1024.36 ( i ), and ( 3 ) a Notice of Error under the Real Estate Settlement Procedures Act, 12 U.S.C. 2605 ( e ), and 12 C.F.R. 1024.35. XXXX XXXX obtained a mortgage loan secured by the property located at XXXX XXXX XXXX XXXX, XXXX, WV, XXXX on XX/XX/XXXX. She died on XX/XX/XXXX. We are the successors in interest : XXXX is XXXX 's son and XXXX XXXX is XXXX 's wife. We are both on the deed of trust and we are both on the deed. You have this information. Since XXXX XXXX, we have asked for help. You told us to not make payments while the loss mitigation was happening, and we tried to get status as successor in interest. We submitted the information you requested and denied us on XX/XX/XXXX, even though you had the information. We tried to sell the home in XX/XX/XXXX, but you would not provide us a pay off statement because we were not on the account. On XX/XX/XXXX, you told XXXX that he was confirmed successor in interest, which, because we had previously submitted all the information to you that you had requested, we were thankful. See attached letter stating in the upper right : Successor in Interest Status Confirmed. Then, you provided us notice on XX/XX/XXXX, that we were not confirmed because you needed the deed. See attached. This is confusing because nothing has changed and we are both on the deed that you have. Also, see attached deed again. Not only is XXXX a confirmed successor in interest, but our application is complete. That XX/XX/XXXX notification is incorrect. Because no foreclosure sale was scheduled as of the date the complete application was submitted, which was at least before XX/XX/XXXX, Rocket Mortgage is required to permit XXXX and XXXX to appeal the denial. 12 C.F.R. 1024.41 ( h ) ( 1 ). This appeal is timely. During the pendency of the appeal, Rocket Mortgage is prohibited from initiating or continuing foreclosure activity. 12 C.F.R. 1024.41 ( f ) ( 2 ) ( i ). Accordingly, Rocket Mortgage must immediately reconsider us for all available loss-mitigation options and cease foreclosure efforts. Next, you must immediately confirm our status and consider us for loss mitigation. We want to save our home and figure out options to avoid foreclosure. Instead, you are pursuing foreclosure on XX/XX/XXXX, and that's unfair. NOTICE OF ERROR Please treat the following as a " notice of error '' under the Real Estate Settlement Procedures Act, 12 U.S.C. 2605 ( e ), and Regulation X, 12 C.F.R. 1024.35. 1. Rocket Mortgage failed to evaluate XXXX XXXX for all available loss mitigation options 2. Rocket Mortgage failed to advise XXXX XXXX of his right to appeal 3. Failure to accept a payment that conforms to the servicer 's written requirements for the borrower to follow in making payments 4. You told us to not pay, and we got further behind in arrears 5. Failing to give us an accurate payoff balance amount upon our request 6. Failing to provide accurate information to us regarding loss mitigation options and foreclosure 7. Filing for foreclosure when we have pending applications and have denied us successors in interest the same time telling us that XXXX is a successor in interest. 8.
