Consumer Narrative
I am submitting this complaint regarding unauthorized ATM withdrawals from my Chase checking account. I discovered multiple ATM withdrawals that I did not authorize. There were approximately twelve withdrawals in amounts ranging between XXXX and XXXX dollars each, totaling approximately {$3100.00} dollars. These transactions are highly unusual and do not match my normal banking activity. At all times, my debit card was in my possession and was not lost or stolen. I did not share my debit card or my PIN with anyone and did not authorize any person to access my account. After discovering the withdrawals, I immediately contacted Chase Bank and reported the transactions as fraud. A fraud claim was opened, and I was initially informed that the amount would be reimbursed. However, Chase later denied reimbursement solely on the basis that the withdrawals were completed using a PIN. Chase did not provide evidence that I authorized these transactions. The denial was based only on the use of a PIN, despite the fact that PIN usage alone does not establish customer authorization. A Chase representative informed me that the withdrawals were made at a Chase ATM. My bank statements do not show the withdrawal times, and I was not present at any ATM when these transactions occurred. I have filed a police report to document the unauthorized activity and am requesting that Chase conduct a proper reinvestigation under Regulation E of the Electronic Fund Transfer Act. I believe the denial of my claim was improper and did not meet the requirements of a reasonable investigation. I am requesting that Chase reverse the denial and reimburse the unauthorized withdrawals totaling approximately {$3100.00} dollars.
