Consumer Narrative

On XXXX XXXX, XXXX, I went in person to a U.S. Bank branch to close my business checking account and withdraw my funds the same day. My U.S. Bank app shows an available balance of {$24000.00}. Bank staff told me there was a hold/restriction related to identity verification. I provided everything they requested to verify me and my address, including government-issued ID, SSN verification documents, and proof of address ( gas bill and internet bill ). After I provided these documents, the bank still refused to release my funds and refused to close the account that day. I was told they will not close the account or release my funds until Friday, XXXX XXXX, XXXX, even though the funds show as available. The bank has not provided a clear written explanation of the restriction, a specific reason code ( deposit hold vs. account restriction ), or a written basis for delaying closure and payout. I requested written confirmation of ( 1 ) why the restriction remains after verification, ( 2 ) whether this is being treated as a funds-availability hold under Regulation CC or an internal fraud/CIP restriction, and ( 3 ) the exact date/time and method the bank will release my funds. I also believe I was profiled and treated differently based on my name and race. A bank employee who identified herself as XXXX handled or influenced the decision and I believe her actions were based on personal bias rather than an objective policy reason. I am requesting investigation into whether discriminatory treatment impacted the banks decision to restrict access to my funds and delay closure. Legal/regulatory concerns raised for review include : ( a ) whether the bank is misapplying funds availability rules under Regulation CC ( 12 C.F.R. Part 229 ) if they are claiming a 7-day delay not tied to a valid deposit-hold exception, ( b ) whether the banks conduct is unfair or deceptive in withholding access without clear written basis or timeline ( UDAAP concerns under 12 U.S.C. 5531 ), and ( c ) whether race-based discrimination affected the performance/termination of a banking relationship, implicating rights protected under 42 U.S.C. 1981 ( equal right to make and enforce contracts ).
