Consumer Narrative

XXXX XXXX XXXX To : Aidvantage XXXX : U.S. Department of Education XXXX Attorney General XXXX Consumer Financial Protection Bureau ( CFPB ) XXXX XXXX, and XXXX ( Credit Bureaus ) XXXX XXXX XXXXXXXX and XXXX and XXXX XXXX Federal Trade Commission Sent via Fax and US Mail Subject : Formal Dispute of Student Loan Accounts Lack of Proof and Wet Signature ( See all details below ) AidAdvantage Account Dear Aidvantage, I am once again disputing the validity of this debt and formally requesting validation under the Fair Debt Collection Practices Act ( 15 U.S.C. 1692g ). I do not recognize this debt and dispute that I owe the amount claimed ( or any amount ) to your agency. To date you have NEVER validated this debt no matter how many times I have contacted your office. Please provide the following verification : XXXX. Proof that I am legally obligated to pay this debt, including a copy of the signed promissory note or loan agreement bearing my wet signature. XXXX. A complete account history, including the original creditor, date the debt was incurred, itemized charges, payments made, and how the current balance was calculated. XXXX. Documentation showing your agency has the legal right to collect this debt ( e.g., chain of assignment or bill of sale from the original creditor ). XXXX. The name and address of the original creditor. XXXX. Proof that the statute of limitations has not expired on this debt. Until you provide this validation, cease all collection activities on this alleged debt, including harassing phone calls, letters, and credit reporting. If you have already reported this to any credit bureaus, mark it as disputed immediately. All future communication must be in writing and sent to the address above. Please do not contact me by phone. Please, to avoid any possible confusion or misunderstanding now or in the future, I am writing to formally dispute and demand immediate investigation and removal of certain student loan accounts that have been reported in my name. I believe that these Aidvantage accounts are inaccurate, unverifiable, and in violation of my consumer rights under the Fair Credit Reporting Act ( FCRA ) and the Fair Debt Collection Practices Act ( FDCPA ). Again for well over a decade, I have repeatedly requested documentation validating these alleged student loans. To date, nothing has been provided that substantiates the debt. XXXX. A signed, original promissory note containing my wet signature. XXXX. Valid proof that I authorized or accepted these alleged loans. XXXX. Proper chain of title or assignment showing lawful ownership of the debt. Without such documentation, these accounts are unsubstantiated and must be deemed fraudulent, inaccurate, or otherwise unverifiable. Continued reporting of unverifiable debt is a violation of federal law. My formal demands are as follows : XXXX. Immediately delete all disputed student loan accounts from my credit reports. XXXX. Provide me with copies of any original signed contracts or promissory notes bearing my wet signature. XXXX. Cease all collection activities and unlawful reporting until such proof is provided. XXXX. Notify me in writing of the results of your investigation within the statutory timeframe. Failure to comply will leave me no choice but to pursue all available remedies This letter serves as my official notice under the FCRA and FDCPA. I expect full compliance with my rights as a consumer.
