( SPS ) Product : Mortgage Issue : Trouble during payment process / Struggling to pay mortgage ( Loss Mitigation ) Complaint Description : I am XXXX XXXX, and I am filing this complaint against Select Portfolio Servicing ( SPS ) regarding two properties : XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXXXXXX ( Loan No. XXXX ) and XXXX XXXX XXXX XXXX, XXXXXXXX XXXX XXXXXXXX ( XXXX XXXX. XXXX ). I have been attempting to obtain mortgage assistance for both loans. However, SPS is systematically preventing my applications from being deemed " complete '' through a cycle of conflicting and contradictory instructions. The pattern of abuse is as follows : I am requested to provide specific documentation. I provide the documentation exactly as instructed by an SPS agent. A different agent then informs me the document is incorrect and gives new, contradictory guidance. When I follow the new guidance, the next agent reverts to the original requirement or identifies a new " error. '' This " run-around '' has led to repeated denials for incompleteness, forcing me to restart the application process while the foreclosure clock continues to tick. This is a clear violation of RESPA ( 12 CFR 1024.41 ), which requires servicers to exercise reasonable diligence in obtaining a complete application. By providing conflicting instructions, SPS is obstructing my right to a full evaluation for loss mitigation options. I have already sent a formal Notice of Error ( NOE ) to the company on XX/XX/year>. I am requesting that the CFPB intervene to ensure SPS : Ceases foreclosure activity immediately while this is investigated. Consolidates my files under a single point of contact who can provide consistent, lawful instructions. Reviews my applications for all available loss mitigation options as required by law.
