Consumer Narrative

I am filing a complaint regarding deceptive and unlawful practices by a debt collection agency. I received a phone call from a representative who asked me to verify my identity before they would disclose who they were or what company they worked for. When I asked for the name of their company, the caller stated that it was against the law for them to identify themselves unless I verified my personal information first. This is false and violates the Fair Debt Collection Practices Act ( FDCPA ), which requires debt collectors to provide meaningful disclosure of their identity. After the call, I dialed the number back and discovered it was a collections agency. I then called to report how inappropriate the initial conversation was. During this follow-up call, the representative claimed that they can not identify themselves or their employer when calling me because it would violate HIPAA. This is completely incorrect. HIPAA does not prevent a debt collector from stating their name, the collection agency they work for, or the purpose of the call. Their explanation appears to be a deceptive attempt to obtain personal information from me without properly identifying themselves. The agencys conduct constitutes misleading and deceptive communication in violation of the FDCPA. Specifically : They refused to provide meaningful disclosure of the callers identity. They made false statements about the law, claiming it is illegal to tell me who they work for. They falsely invoked HIPAA as a justification for withholding required identification. Their actions appear intended to pressure me into disclosing personal information before confirming the legitimacy of the caller.
