Bank : Bank of America Product : Credit Card / Debit Card Issue : Dispute Handling Improper Denial I am filing this complaint because Bank of America improperly denied my dispute twice despite overwhelming evidence of fraud, damaged merchandise, and services not rendered. The merchants statements were false, and Bank of America failed to review the evidence I provided. On XX/XX/year>, I faxed an XXXX evidence packet to the Bank of America Disputes Department , containing : Full text messages with the merchant Photos showing the tiny home intact before purchase This fax was successfully delivered and confirmed by the fax receipt. On XX/XX/year>, I emailed over : Photos/video of the tiny home destroyed during delivery Witness statements Video stills showing the delivery crew dropping the unit Payment receipts Timeline of events Proof of city involvement, civil suit filed and policy report The merchant damaged the prefabricated home during delivery on XX/XX/XXXX and XX/XX/year>. Video evidence shows the installation crew dropping the home while attempting to put it down, causing immediate structural damage. XXXX neighbors witnessed the incident and provided written statements confirming the damage occurred on-site during delivery, not prior. After damaging the unit, the delivery crew abandoned it on city soil in front of my property, creating a public safety hazard. XXXX XXXX XXXX XXXXXXXX has since opened an investigation. A police report has also been filed, and I have opened a civil lawsuit against the merchant. I can not access the unit because the keys were never left or given to me. It remains damaged, unsafe, unusable, and not installed. The merchant did not deliver the product or perform the services promised. Despite all of this, Bank of America denied my dispute twice and failed to review or consider the evidence that was already in their possession. The merchant responded with false information, and Bank of America accepted it without verifying my documented proof. I am requesting that the CFPB review this matter and require Bank of America to : 1. Conduct a proper investigation 2. Reopen the dispute 3. Assign the case to an executive-level dispute specialist 4. Reverse the improper denial and issue a refund for the {$2600.00} ( delivery & installation and {$25000.00} ( purchase of the unit ) charge. Bank of Americas handling of this dispute has been negligent and unfair. I have provided more than enough evidence to prove that the merchant damaged the product, failed to deliver the service, and misrepresented the situation. I am requesting immediate assistance in resolving this matter. Requested Resolution : Reopen the dispute, issue a refund, and ensure proper review of all evidence submitted on via fax, email and in this complaint.
