Consumer Narrative

I am submitting this complaint because the company is attempting to collect a debt that is not mine, was never validated, and appears to be a re-aged, identity-theft-related account that the collector is falsely attaching to my current legal name, even though the original alleged debt was reported under a former legal name. This is an ongoing pattern of misconduct involving multiple furnishers and repeated failures to comply with federal law. I have filed multiple CFPB complaints and numerous disputes with XXXX, XXXX, and XXXX, and in every instance the company has refused to provide the legally required validation of the debt. They have not sent a single document by mail or electronically that shows : A signed contract or application in my name Proof I ever opened a XXXX XXXX account in XX/XX/year> Proof of assignment or legal right to collect An itemized accounting The original date of delinquency A lawful basis for re-aging the account Any documentation supporting the information reported to the credit bureaus My credit reports have been frozen for almost a year due to identity theft. I have not opened any accounts, especially not in XX/XX/year>, the date the collector is claiming the alleged XXXX XXXX account was opened. This proves the debt can not be mine. This is not the first time this company has ignored federal law. I previously submitted a CFPB complaint requiring validation. The complaint was closed without resolution, and the furnisher provided zero documentation, despite my specific and repeated requests. They simply continued reporting the account without proof, violating : FDCPA ( 15 U.S.C. 1692g ( b ) ) continuing collection after validation request FCRA ( 15 U.S.C. 1681s-2 ( b ) ) failure to investigate disputes reasonably FCRA 623 ( a ) ( 1 ) ( A ) furnishing information known to be inaccurate FCRA 611 failing to correct inaccurate or incomplete data FCRA 605 ( a ) ( 5 ) illegal re-aging CFPB Regulation F requirements Nothing has ever been mailed to me despite multiple disputes, multiple bureau investigations , and multiple CFPB complaints. The collector appears to be reviving an old identity-theft-related debt under my former legal name and reattaching it to my current legal name, despite : my documented name change, identity theft reports on file, bureau freezes in place, and multiple prior disputes. This constitutes fraudulent re-aging and an attempt to illegally collect debt from the wrong consumer. I have disputed this exact account with TransUnion multiple times. TransUnion has marked the account as consumer disputes but continues to display : incorrect dates, incorrect opening history, incorrect responsibility type, incorrect balance, and an impossible Date Opened XX/XX/year>. No response or documentation was provided by the collector to menot even a form letterdespite the FCRA requirement that furnishers communicate the results of an investigation to the consumer. XXXX and XXXX have similar patterns with other furnishers in my prior complaints. In every instance : they claim the furnisher verified the account without providing evidence, they fail to provide results or documentation by mail, they continue to report accounts opened under my former legal name despite having my updated legal name on file, and they have failed to correct inaccurate and conflicting information across bureaus. This shows an ongoing pattern of systemic failure to investigate disputes, which harms consumers and violates the FCRA. This collector is now reporting a XXXX XXXX account with : Opened : XX/XX/year> ( impossible report was frozen, no accounts opened ) Balance : {$380.00} Placed for collection Using a Virginia address Tied to me despite no legal contract, no validation, and no evidence connecting me to this debt This is an attempt to unlawfully re-age a debt I do not owe by fabricating a new opening date and linking it to my current legal identity. I have received : No validation of debt No signed contract No documentation of transfer or assignment No date-of-first-delinquency documentation No mailed investigative results No proof this account belongs to me The collector continues to report the account despite having zero evidence. The continued reporting after a validation request and multiple disputes is illegal. I am requesting CFPB intervention because the furnisher has fully ignored my rights under federal law, repeatedly harmed my credit, and refused to validate the debt after being given multiple opportunities.
