I am submitting this complaint regarding serious errors and misconduct by JPMorgan Chase Bank, N.A., which have caused me significant financial and emotional harm. The events are as follows : XX/XX/year> : My spouse, XXXX, who is not on the mortgage loan, added himself as a successor in interest with Chase. This was done using a recorded deed, marriage license, and ID, despite : An active order of protection preventing contact, Legal separation and ongoing divorce proceedings. XX/XX/year> : Chase canceled my pending mortgage modification, citing XXXX authority as successor-in-interest, even though he had no legal right to act on the loan. The notification I later received from Chase explicitly stated that a successor-in-interest is for informational purposes only and can not make binding decisions. Yet they let him cancel my modification request. XXXX XXXX : I was forced to reapply for a modification due to Chases cancellation, creating unnecessary delays and financial hardship. XX/XX/year> : Chase transferred my mortgage to XXXX XXXX, leaving me in limbo. Without properly addressing my complaints and concerns they dumped me. XX/XX/year> : Chase sent me a XXXX letter XXXX via XXXX XXXX TRACKING NO XXXX offering a trial modification plan for $ XXXX/month for three months. I have proof of sending certified payments for XXXX, XXXX and XXXX in good faith, fully complying with the trial plan. XX/XX/year> : XXXX XXXX began debt collection activity, ignoring my payments and the ongoing modification plan. Issues with Chases Actions : Unauthorized Interference / Servicing Errors : XXXX had no legal authority to cancel my modification. Chase failed to consider my protective order, marital separation, and non-borrowing status. They enabled further abuse financial creating harm to my minor children and I This is a violation of federal Regulation X ( 12 C.F.R. 1024.41 ) regarding loss mitigation and successor-in-interest rights. Trial Plan Abandonment/ Improper Loan Transfer : Chase approved a trial modification plan and offered payments in good faith, then sold the loan before the first trial payment. This created financial uncertainty and disrupted my ability to catch up on the mortgage. Financial and Emotional Harm : I fell behind on my mortgage due to illness and loss of income, which was exacerbated by the stress and trauma of the XXXX XXXX situation I was experiencing. Chases actions allowing my XXXX to interfere with my mortgage, cancelling my modification, and transferring the loan during my trial plan directly enabled further financial abuse by the same person. As a result, I and my children have suffered XXXX XXXX, housing instability, and increased risk of homelessness. Failure to Protect Borrower Rights under XXXX XXXX : Chase allowed my abuser to interfere indirectly, despite an active order of protection. This created financial abuse through the banks actions.
