Consumer Narrative

I am filing this complaint because Portfolio Recovery Associates ( PRA ) is reporting two separate collection accounts for the same alleged debt, both with different account numbers. That is the first violation, and PRA knows better. Duplicate reporting is a direct violation of FCRA 607 ( b ) ( maximum possible accuracy ). Accounts Reporting : XXXX {$3900.00} FIRST {$3900.00} Original Creditor : XXXX XXXX XXXX I have never received any written notice before this collection was placed on my credit report, which violates FDCPA 809 ( a ). PRA placed this on my credit with no notification and has continued to furnish and attempt to collect without ever validating anything. I requested validation on : XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX XX/XX/XXXX It has been months, and I still have not received one single piece of legally required documentation. YOU ALL HaVE a Long History of Lawsuits I am fully aware of PRAs history, including but not limited to lawsuits for : Suing consumers without proof of debt Attempting to collect debts they can not validate Failing to provide validation when requested Reporting inaccurate or duplicated information Unlawful collection practices Misrepresenting balances Violating consent decrees Failing to maintain proper documentation Improper verification responses PRA has paid millions in settlements for these exact same behaviors. So yes, I know your tactics, and this situation lines up perfectly with PRAs documented pattern of illegal practices. What PRA Failed to Provide ( Required by Law ) When a consumer disputes a collection, this is what the law requires PRA to send : FDCPA 809 ( b ) Verification Required You must provide : Original signed contract or agreement with my signature Full itemized accounting/ledger showing how the balance was calculated Proof of ownership/assignment from XXXX XXXX XXXXXXXX Complete account history from day one Documentation from the original creditor, not PRAs internal notes Evidence the amount is accurate and legally owed Sending a bill, invoice, or basic screenshot is not validation. You have not provided any of the required documents. FCRA XXXX XXXX XXXX Violations PRA is violating : FCRA 607 ( b ) Inaccurate duplicate accounts FCRA 611 ( a ) Failure to reasonably investigate FCRA 611 ( a ) ( 5 ) Items must be deleted if unverified XXXX XXXX guidelines PRA can not certify accuracy without documentation YOU ALL marked these accounts verified with zero proof, which is illegal.
