A lawsuit was filed against me by Portfolio Recovery for a debt collection regarding a synchrony bank XXXXXXXX XXXX. XXXX writ of garnishment was filed when there was already a motion granted by the court to stay the case pending the outcome of arbitration. Their lawyer spoke with me on the phone and began to threaten me with having to cover their arbitration fees as once the case went to arbitration. Also, despite the arbitration clause in the original contract stating that whoever brought the claim to court would be responsible for commencing arbitration, the lawyer tried telling me that it was my responsibility to initiate the process. The lawyer also followed up via email reiterating that it was my responsibility to initiate the arbitration. Now, after filing a writ of garnishment, which was erroneously granted by the court, the judge has vacated, the summary judgment and get rid of garnishment that were granted erroneously however, the creditor has still not reached out to the garnishee, which is my employer to let them know that the rate of garnishment was vacated so now they have begun to take money from my paychecks and have failed to let my job know that the writ of garnishment is no longer valid. To me, it appears that they are giving me false information in an attempt to get me to commence the arbitration process when the contract clearly states that whoever brings the case to court is responsible for initiating, if the other parties force arbitration. The plaintiff has sought a summary judgment and rid of garnishment despite the case being stayed for arbitration and now they are taking money from my paycheck illegally. To me, this is a clear indication of improper process in the court system. This is also an instance of harassment and false information.
