I am filing a complaint against XXXX XXXX XXXX XXXX XXXX regarding inaccurate and unlawful credit reporting on my account ending in XXXX. My XXXX credit report shows that XXXX XXXX has reported monthly delinquency codes from XXXX through XXXX. This is not possible, as the account was closed and charged off in XXXX, and my last payment was made on XX/XX/XXXX. There has been no activity since that date. A charged-off account can not generate new late payments after the Date of First Delinquency. This appears to be illegal re-aging and violates FCRA 623 ( a ) ( 5 ) and 605 ( a ). XXXX is also reporting a balance of {$880.00}, a past-due amount of {$880.00}, and both a scheduled and actual payment of {$880.00} for multiple years. This is factually impossible because no payments have been made since XXXX. This violates FCRA 607 ( b ) and the furnishers duty to correct inaccurate information under FCRA 623 ( a ) ( 2 ). I received two letters from XXXX XXXX dated XX/XX/XXXX. One letter states that they can not change information that has been reported accurately, even though the information is not accurate. The second letter confirms a settlement amount of {$440.00} and states the account will be reported as charged off and paid in full for less than the full balance. This settlement amount contradicts the {$880.00} balance and past-due amounts being furnished to XXXX. These two letters contradict each other and directly conflict with what is being reported on my credit file. The combination of the false delinquency history, the incorrect balance and past-due amounts, the inaccurate payment history, and the contradictory letters from XXXX XXXX shows that the account is not being reported in compliance with the Fair Credit Reporting Act. I am requesting that the CFPB require XXXX and XXXX XXXX to conduct a lawful reinvestigation and correct all inaccurate information. This includes removing all delinquency codes reported after the charge-off date, correcting the balance and past-due amounts to reflect the true historical data, and applying the correct Date of First Delinquency from XXXX. If the furnisher can not provide legally valid proof to support the reporting, I request that the entire tradeline be deleted from my credit file in accordance with FCRA 611.
