Consumer Narrative

Debt collector failed to provide full validation including chain of title, account-level documentation, and full accounting. They attempted to collect despite a prior court ruling dismissing their case ( # XXXX ). They continue to report without legal basis, violating FDCPA 807 and FCRA 623. I am filing a complaint against Portfolio Recovery Associates , LLC ( PRA ) regarding their continued reporting of a debt that they have not properly validated and for furnishing incomplete and misleading information to the credit bureaus. Summary Portfolio Recovery Associates began reporting a derogatory collection account for a debt they claim to own. I disputed the debt and request full validation. PRA sent only a generic verification letter, which does not satisfy the legal validation requirements under the FDCPA ( 15 USC 1692g ). Despite this lack of proper validation, PRA continues to : Report the account as active and derogatory, has not removed it from my credit report Furnish inconsistent and incomplete information to different bureaus. This is harming my credit and preventing me from qualifying for financing, including a recent home repair loan. Validation Issues PRA has not provided : A copy of the original signed agreement or contract, Proof of assignment or chain of title, A complete itemization of the balance, A full payment history, Documentation proving they have a legal right to collect in my state. They have only provided a single-page verification letter, which is not legal validation. Under the FDCPA, if the collector can not validate the debt, they must cease collection activity, including reporting. PRA has not done so. Credit Reporting Issues PRAs reporting is : Potentially in violation of the FCRA. They continue to update the account after failing to validate, which is considered continued collection activity. Additionally, PRA has not provided a response with real documentation to the credit bureaus when disputes were submitted.
