Consumer Narrative

I am submitting this complaint to report an inaccurate, unverified, and unauthorized account appearing on my consumer credit report under the furnisher THD/CBNA, with the account number ending in XXXX. I want to state clearly and without ambiguity that I do not own this account, have never opened any account with THD/CBNA, and have never authorized any credit line, loan, or financial product associated with this furnisher. The account does not belong to me in any capacity, and its presence on my credit report represents a serious failure in identity authentication, verification, or data accuracy. Despite the fact that I have no relationship with THD/CBNA, this account has been reported as a collection/charge-off with derogatory history, including missed payments and negative status indicators. I have never received any billing statements, notifications, collection letters, account-opening documents, or any other form of communication from THD/CBNA regarding this alleged account. My complete lack of knowledge and involvement in this account demonstrates that the information is either the result of identity theft, clerical error, mixed file, furnisher misreporting, or an incorrect association created by a data-matching error. Because the account is not mine, it should not appear on my credit report, nor should it be furnished, verified, or treated as legitimate without providing original documentationnone of which has been produced by THD/CBNA or XXXX credit reporting agency. I am requesting the CFPBs assistance in ensuring proper reinvestigation and removal of this inaccurate information. XXXX. The Account Does Not Belong to Me and Has No Connection to My Identity I have never opened a credit account with THD/CBNA. I have never initiated a credit application, online or in-person, that would authorize the creation of this account. I have never signed any contract, agreement, disclosure, or credit instrument with THD/CBNA or any of its affiliates. I have never used a THD/CBNA credit card, nor have I ever received a card, welcome package, billing statement, email, or any other communication reflecting the existence of such an account. No legitimate creditorconsumer relationship ever existed. Because the accounts origin is unknown to me, it can not be lawfully attributed to me. The appearance of the THD/CBNA account on my credit file is therefore not the result of legitimate activity. It represents unverified and inaccurate data that remains on my report without legal justification. XXXX. I Disputed This Account With the Credit Bureaus, but No Proper Validation Was Provided Once I discovered the THD/CBNA account on my credit report, I filed disputes with the credit bureaus, as allowed under the Fair Credit Reporting Act ( FCRA ) 611 ( a ). In each dispute, I clearly stated that : I do not own the account I never applied for it I never signed anything I never authorized its creation I have never been contacted by THD/CBNA regarding the account However, the credit reporting agencies returned results claiming that the furnisher verified the account. These so-called verifications were not accompanied by any supporting documentation. I was not provided copies of : A signed application A promissory agreement Proof of identity validation Billing statements Opening date records Payment history tied to my identity Evidence of my consent Any validation under FDCPA 809 ( b ) The FCRA requires credit bureaus to conduct a reasonable reinvestigation, not a superficial automated check. Furnishers can not simply confirm internal datathey must validate it. No bureau or furnisher has met that legal obligation. 3. THD/CBNA Did Not Provide Original Documentation to Confirm Ownership If THD/CBNA intends to report this account as mine, they must be able to produce the original account-opening documentation. This includes : A signed credit agreement The application information submitted at account opening Documented identity verification procedures Digital signature or electronic consent logs IP data, timestamps, geolocation records A complete chain-of-custody record if the debt was sold or transferred Demonstrable proof that my identity was authenticated at the time of account creation THD/CBNA has produced none of these materials. Without evidence, their reporting is unlawful under : FCRA 623 ( a ) ( 1 ) ( A ) ( duty of furnishers to report accurate information ) FCRA 607 ( b ) ( maximum possible accuracy standard ) FCRA 611 ( a ) ( 5 ) ( requirement to delete unverifiable information ) FDCPA 809 ( b ) ( validation requirement for collection accounts ) Their failure to produce documentation shows the account can not be verified and therefore must be deleted. 4. This May Be a Case of Identity Theft, File Mixing, or Data Misassociation There are several possible explanations for how this fraudulent account appeared on my file, none of which relate to my actions : A. Identity Theft A third party could have used my name, but THD/CBNA has never provided proof of verification such as : Photo ID checks SSN matching Address validation Phone or IP authentication B. Mixed File My name or similar identifiers may have been accidentally merged with another consumers data. Mixed files are a known and serious problem within CRA systems. XXXX XXXX XXXX THD/CBNA XXXX have incorrectly linked the account to my identifiers through clerical or database errors. XXXX Outdated or corrupt data The account XXXX have been incorrectly transferred or misassigned through automated systems such as e-Oscar. Regardless of the cause, I do not own the account, and THD/CBNA has not proven otherwise. XXXX. Continued Reporting Is Damaging My XXXX and XXXX XXXX XXXX The derogatory nature of the THD/CBNA accountlisted as a collection/charge-off with multiple late payments and a past-due balancehas caused substantial harm to my creditworthiness. This inaccurate account affects : My XXXX XXXX My ability to secure fair lending terms My housing applications My insurance rates Employment background checks The FCRA was enacted to protect consumers from exactly this type of harm. THD/CBNAs failure to validate the account exacerbates the damage. XXXX. THD/CBNA Failed to Perform a Proper Reinvestigation A lawful reinvestigation requires : Reviewing original documents Comparing consumer-provided evidence Determining accuracy based on verifiable data Notifying all bureaus of corrections or deletions Instead, it appears that THD/CBNA simply responded verified through automated dispute systems without reviewing original documentation. XXXX verification is not complianceit is a procedural shortcut that violates consumer rights. XXXX. The Credit Bureaus Also Failed to Provide the Method of Verification When I requested the MOV required under FCRA 611 ( a ) ( 6 ), the bureaus did not provide : The name of the person who verified the account The system used The documentation reviewed Whether it was manual or automated A description of the actual investigative process This violates federal law. XXXX. THD/CBNA Has Not Demonstrated Legal Standing to Report This Account If THD/CBNA continues to report this account as mine, they must demonstrate : That the debt is valid That I am the lawful account holder That they are the correct owner or servicer That they have standing to report the debt No such proof has been provided. XXXX. My Federal Rights Have Been Violated The following rights have been violated : FCRA Rights Violated : 602 ( A ) : Right to fair and accurate reporting 607 ( b ) : Accuracy obligation 611 ( a ) : Right to reasonable reinvestigation 611 ( a ) ( 6 ) : Right to method of verification 623 ( a ) ( 1 ) : Prohibition on inaccurate reporting 611 ( a ) ( 5 ) : Deletion of unverifiable information FDCPA Rights Violated ( if collections involved ) : 809 ( b ) : Right to validation 807 : Prohibition on false representation 808 : Prohibition on unfair practices Because the account does not belong to me, every reporting instance is a misrepresentation. 10. A Fair Resolution Requires Removal of This Fraudulent Account To correct this situation, a fair resolution requires that THD/CBNA and all credit bureaus : Immediately delete the THD/CBNA account ending in XXXX from my credit file. Provide written confirmation of the deletion. Provide all documentation used to support any prior verification. Suppress the account during reinvestigation so no further harm occurs. Notify all users of my credit report who viewed the inaccurate information in the last 624 months. Recalculate my XXXX XXXX without the false negative data. Ensure no reinsertion occurs without full certification and written notice. XXXX a compliance review to determine how the error occurred. This is the only legally compliant and fair resolution. XXXX. I Am Not Refusing to Pay a DebtThis Debt Simply Is Not Mine I want to be clear : This is not a dispute about payment, negotiation, settlement, or hardship. I simply do not own this account. There is no legal, financial, or factual basis for associating the THD/CBNA account with me. XXXX. Continued Reporting Without Proof Constitutes Willful Noncompliance If THD/CBNA continues XXXX report this account without being able to produce original signed documents, this becomes willful noncompliance under FCRA 616617 , which permits remedies and damages. My goal is not litigationI simply want accurate reporting and compliance with federal law. But if they can not verify the account, it can not remain. XXXX. Summary In summary : The THD/CBNA account ending in XXXX is not mine. I never opened or authorized it. No documentation exists proving I own it. The bureaus verification was improper. The furnisher did not validate the account. Its continued reporting violates my FCRA and FDCPA rights. The only fair and lawful resolution is permanent deletion. XXXX. My Request to the CFPB I am respectfully requesting that the CFPB : Intervene to ensure the furnisher and bureaus comply with federal law Require THD/CBNA to produce real documentation or delete the account Ensure the CRAs conduct a lawful reinvestigation Ensure the inaccurate account is permanently removed I simply want my credit file to reflect only true, accurate, and verifiable information. This account does not meet those standards.
