On XX/XX/XXXX, Bank of America ( BoA ) allowed my former husband, XXXX XXXX, to open a credit card ( XXXX ) with me listed as a co-borrower without my consent or knowledge. On the same day, XXXX transferred his balance from XXXX of {$15000.00} to this BoA card. On XX/XX/XXXX, XXXX XXXX, and I am his executor. It was only through the probate process that I learned I was listed as co-borrower for this debt. I immediately called BoA to inquire how this could have happened. I explained that XXXX and I were legally divorced when the debt was incurred. I further explained that I have a Separation Contract filed in the XXXX XXXX XXXX XXXX clearly stipulated any BoA debt belonged to XXXX, not me, and that, as primary borrower, he was responsible for closing all joint accounts. Nevertheless, BoA refused to take responsibility and explained my only option was to file a fraud claim again XXXX, which I promptly did in XX/XX/XXXX. BoA agreed to pause any payments and fees until the matter was closed. On XX/XX/XXXX, I called BoA to check on the status because I hadn't heard back and I had received several late fees that lowered my credit score. BoA told me I canceled my claim. I vehemently explained that was not the case and requested a copy of the recorded phone conversation where this allegedly took place. They refused but agreed to reopen my fraud claim. Several weeks later I received a phone call requesting me to fax to BoA his death certificate and proof of our divorce, which I did. On XX/XX/XXXX, I called to check on the status again because BoA is still not communicating with me and they continue to charge me penalties, which are destroying my credit score. I was told my claim was denied and I am liable for the debt. I asked why I was not notified and the BoA representative apologized. She confirmed there is no record on my online account that BoA notified me of the outcome. Despite providing all requested documentationincluding proof of divorce and proof of XXXXBank of America has failed to resolve this matter appropriately. I have been repeatedly misinformed by BoA representatives, including being told I canceled my claim, which I did not, and I continue to incur late fees and penalties despite assurances from BoA that all fees would be on hold pending resolution of the fraud claim. I have spent XXXX hours on the phone with BoA trying to resolve this matter and am enraged. Under federal law and Bank of America policies regarding unauthorized account activity and fraud claims, I am not liable for this account, and the assessment of fees and interest is improper. I respectfully seek your assistance in holding BoA accountable for : -Immediate reversal of all fees, interest, and penalties associated with this account. -Removal of any recorded liability for this account from my name. -Written confirmation that my fraud claim is being fully upheld and that no adverse credit reporting will occur. I have documentation to validate every detail. I also have notes from all communication with BoA regarding this matter and every phone call I had with BoA was recorded. Please help me!
