I am submitting this complaint against Rubin & Rothman , LLC, acting on behalf of XXXX XXXX XXXX XXXX, for initiating a small-claims action in XX/XX/XXXX for a debt of {$5600.00} ( or any other amount ) which I did not incur and for which I never entered into or authorized any agreement. I am a victim of identity theft, and I am not the debtor of this account. The debt appears to be based on the fraudulent use of my personal information. UnderXX/XX/XXXX Chapter XXXX, Section XXXX, small claims procedure requires that claims be based on substantive law and properly supported ; the claim advanced by Rubin & Rothman lacks such support, and accordingly, the court must consider vacating or dismissing the matter. Additionally, 15 U.S.C. 1692e of the Fair Debt Collection Practices Act ( FDCPA ) prohibits unfair, deceptive, or abusive practices in debt collection, which Rubin & Rothmans actions seem to violate. 15 U.S.C. 1681e ( b ) of the Fair Credit Reporting Act ( FCRA ) requires that all information reported to credit bureaus be accurate, and Rubin & Rothmans actions have led to the continued reporting of inaccurate and fraudulent information regarding this debt. I respectfully request that the CFPB investigate Rubin & Rothman , LLC for pursuing this unjustified small claims lawsuit in Massachusetts, ensure that they cease their collection efforts, and require them to comply fully with Massachusetts small claims law, the FDCPA ( 15 U.S.C. 1692e ), and the FCRA ( 15 U.S.C. 1681e ( b ) ), as well as the states statutes governing fair collection practices.
